Terms and Conditions of Sale

Last updated: 1 October 2026

These Terms and Conditions of Sale (“Terms”) apply to all orders placed on www.rotary-technical.com (the “Website”). Placing an order means you have read and accepted these Terms. You must tick the acceptance box before confirming your order.

1. Seller

The Website is operated by:

PHONOPTICS, a French simplified joint-stock company (SAS) with a share capital of 151,788 €
Registered office: 13 avenue du Lac, 91080 Évry-Courcouronnes, France
Registered with the RCS of Évry under number 804 652 634 — SIRET 80465263400036
EU VAT number: FR06804652634 — EORI: FR804652634
Brand: Rotary Technical Innovation
Email: support@rotary-technical.com — Phone: +33 9 86 60 83 56

2. Scope

These Terms govern sales of products listed on the Website to consumers and professional buyers. Consumers are protected by the mandatory provisions of the French Consumer Code (Code de la consommation) and, where more protective, by the mandatory consumer law of their country of residence within the European Union. Other provisions apply to professional buyers only where stated.

The Seller may update these Terms at any time. The Terms in force on the date of your order apply to that order.

3. Products

The Website lists the essential features of each product. Product photos are for illustration only and are not contractual.

Some products are aftermarket parts and accessories for the Mazda RX-8 and other rotary-engine vehicles. You are responsible for checking that a product is compatible with your vehicle before ordering. Installing and using products must comply with the regulations in force in your country, including roadworthiness and vehicle approval rules. Some modifications may affect your vehicle’s warranty or insurance.

Products are offered while stocks last. If a product turns out to be unavailable after you order it, we will tell you as soon as possible and refund any amount paid within 14 days.

4. Prices

Prices are shown in euros. VAT is applied at the rate of the destination country for deliveries within the European Union and added at checkout. Deliveries outside the European Union are invoiced without French VAT.

Shipping costs are calculated according to the delivery address and the chosen carrier. They are shown before you confirm your order.

Deliveries outside the European Union: import duties, local taxes and customs clearance fees charged by the destination country are not included in the price. The recipient pays them, unless the Website states otherwise when you order.

The Seller may change its prices at any time. Products are invoiced at the price shown when you confirm your order.

5. Ordering

To place an order:
1. add the products to your cart;
2. enter your billing and delivery details;
3. choose a shipping method and a payment method;
4. review your order summary and correct any errors;
5. tick the box confirming you accept these Terms;
6. confirm and pay for your order.

The contract is concluded once payment is confirmed. We send a confirmation email that summarises the order. The Seller may refuse or cancel an order if there is an existing dispute with the buyer, a suspected fraud or an obvious pricing error.

6. Payment

Payment is due in full when you order. The Website accepts the payment methods shown at checkout: credit or debit card, PayPal and other methods offered by our payment providers. Payments are processed by these certified providers, and the Seller never stores your full card details.

7. Delivery

Products are delivered to the address you provide when ordering. Available carriers include Colissimo, Chronopost and FedEx, depending on the destination. The carrier and estimated delivery time are shown at checkout.

Orders are normally shipped within 3 working days after payment. If we do not deliver within the announced time, or within 30 days of your order if no date was given, consumers may cancel the contract under the conditions of Articles L216-2 et seq. of the French Consumer Code.

Please check the parcel on delivery. Note any damage or missing items in writing with the carrier, and tell us at support@rotary-technical.com within 3 days. As a consumer, the risk of loss or damage passes to you when you, or a person you designate, physically take possession of the products.

8. Right of withdrawal (consumers)

Under Articles L221-18 et seq. of the French Consumer Code, consumers have 14 days from receipt of the products to withdraw from the contract. You do not need to give a reason or pay any penalty.

How to withdraw: use our free online withdrawal function, “Withdraw from contract here”, at www.rotary-technical.com/withdrawal/. A link to it appears at the bottom of every page of the Website, in your customer account next to each order, and in your order confirmation emails. Enter your name, your order number and how you wish to receive the acknowledgment, then click “Confirm withdrawal”. We will send you an acknowledgment of receipt on a durable medium (email, or post if you request it) stating the content of your declaration and the date and time it was sent. You may also send a clear statement by email to support@rotary-technical.com, using the model form below if you wish.

Returns: send the products back within 14 days after notifying your withdrawal, complete and in their original condition, to: PHONOPTICS — Rotary Technical Innovation, 13 avenue du Lac, 91080 Évry-Courcouronnes, France. You pay the direct cost of returning the products. You are liable for any loss in value caused by handling the products beyond what is needed to check their nature, characteristics and functioning, including after installation on a vehicle.

Refunds: we refund all amounts paid, including standard delivery costs, within 14 days of receiving your withdrawal. We may withhold the refund until we receive the products back or you provide proof that you have sent them. The refund uses the same payment method as your purchase.

Exceptions: under Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to products made to your specifications or clearly personalised. This includes the 3D-printed parts (gauge holders, vent mounts, ashtrays), which are manufactured to order according to the options you select.

9. Legal warranties

All products are covered by the following warranties, in addition to any commercial warranty:

  • the legal warranty of conformity (Articles L217-3 et seq. of the French Consumer Code). It covers defects of conformity that appear within 2 years of delivery. You may choose repair or replacement, or, in the cases provided for by law, a price reduction or cancellation of the contract;
  • the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).

To make a claim, contact support@rotary-technical.com with your order number and a description of the problem, with photos where possible.

These warranties do not cover damage caused by incorrect installation, modification, misuse, use in competition, accidents or normal wear.

10. Liability

The Seller is liable only for direct and foreseeable damage caused by non-performance of the contract. The Seller is not liable for damage caused by incorrect installation or use that does not follow the instructions, the regulations or good practice. This clause does not limit any liability that cannot be excluded by law, in particular for personal injury or towards consumers.

11. Personal data

Personal data collected when you order is used to process and deliver your order and to manage the customer relationship. It is shared only with the service providers needed for these purposes: carriers and payment providers. You have rights of access, rectification, erasure, restriction, objection and portability under the GDPR. To exercise them, write to support@rotary-technical.com. You can also lodge a complaint with the CNIL (www.cnil.fr). For more details, see our Privacy Policy.

12. Customer service, complaints and mediation

For any question or complaint, contact support@rotary-technical.com or +33 9 86 60 83 56.

If you are a consumer and a dispute is not resolved with our customer service, you may refer it free of charge to a consumer mediator (Articles L612-1 et seq. of the French Consumer Code). The contact details of the mediator designated by the Seller are available on request from our customer service. You must first have sent a written complaint to the Seller.

13. Applicable law and jurisdiction

These Terms are governed by French law. This does not deprive consumers of the protection of the mandatory provisions of the law of their country of habitual residence. In the event of a dispute, consumers may bring proceedings before the competent court of their place of residence or of the Seller’s registered office. For professional buyers, the courts with jurisdiction over the Seller’s registered office have exclusive jurisdiction.
